Everything seemed ready for customs clearance until, during the pre-clearance review, we detected several critical issues that could have turned into a serious border problem.<\/p>\n\n\n\n<p>This was not a minor detail or a matter of interpretation: the product was intended for children, incorporated electrical components, and the company was not registered as a producer of electrical and electronic equipment, nor did it have demonstrable RoHS documentation.<\/p>\n\n\n\n<p>The decision was clear: <strong><em>do not clear the goods<\/em><\/strong>.<br>Stopping the transaction in time prevented a customs hold, sanctioning proceedings, and costs that would have been much higher once the goods had reached the border.<\/p>\n\n\n\n<p>This case shows why, when we are dealing with electrical products intended for children, reviewing the regulations before customs clearance is not a formality, but a necessity.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Problem-context\" style=\"font-size:clamp(2.629rem, 2.629rem + ((1vw - 0.2rem) * 3.952), 5rem);\"><strong>Problem context<\/strong><\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>The company tells us the following about the products it plans to import:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-center\">\u201c<em>They are used exclusively within a recreational space, under the supervision of operators, and are not intended for domestic use<\/em>.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>Based on this initial approach, the company understands that the ride-on cars <strong>do not fall within the category of domestic-use toys<\/strong> and that, therefore, <strong>certain regulatory obligations would not apply<\/strong>.<\/p>\n\n\n\n<p><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"448\" src=\"https:\/\/www.omniaaduanas.com\/wp-content\/uploads\/2026\/02\/Carrito-test1-1024x448.webp\" alt=\"Import of electric toy ride-on cars\" class=\"wp-image-827\" style=\"width:704px;height:auto\" srcset=\"https:\/\/www.omniaaduanas.com\/wp-content\/uploads\/2026\/02\/Carrito-test1-1024x448.webp 1024w, https:\/\/www.omniaaduanas.com\/wp-content\/uploads\/2026\/02\/Carrito-test1-300x131.webp 300w, https:\/\/www.omniaaduanas.com\/wp-content\/uploads\/2026\/02\/Carrito-test1-768x336.webp 768w, https:\/\/www.omniaaduanas.com\/wp-content\/uploads\/2026\/02\/Carrito-test1.webp 1536w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n<\/div>\n\n\n<p><\/p>\n\n\n\n<p>However, during the technical review prior to customs clearance, <strong>at Omnia we analyzed the product beyond the intended declared use and identified several key elements<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They were electric ride-on cars <strong>intended for children under 14 years of age<\/strong>.<\/li>\n\n\n\n<li>They incorporated <strong>electrical and electronic components<\/strong>.<\/li>\n\n\n\n<li>And the importing company was not registered as a <a href=\"https:\/\/industria.gob.es\/registros-industriales\/RAEE\/Paginas\/preguntas-frecuentes.aspx\">PRODUCER of EEE<\/a> under WEEE, nor did it have RoHS documentation that could be presented in the event of an inspection.<\/li>\n<\/ul>\n\n\n\n<p>Under these circumstances, continuing with customs clearance meant assuming a risk that was not defensible. Recreational use does not exclude toy regulations<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p>One of the key points in this case was the interpretation of the product\u2019s use.<\/p>\n\n\n\n<p>From a regulatory standpoint, what matters is not how the product is intended to be used, but rather:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who it is intended for (children under 14 years of age).<\/li>\n\n\n\n<li>What type of product it is,<\/li>\n\n\n\n<li>And what risks its use entails.<\/li>\n<\/ul>\n\n\n\n<p>In this case, the fact that the use was recreational and supervised does not exclude the application of toy regulations. If the product is an electrical toy intended for children, <strong>it is fully regulated<\/strong>, regardless of where it is used.<\/p>\n\n\n\n<p>Therefore, the Toy Safety Directive and its implementing regulations in Spain apply.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"3.-Automatic-triggering-of-environmental-obligations\" style=\"font-size:clamp(1.743rem, 1.743rem + ((1vw - 0.2rem) * 2.095), 3rem);\"><strong>3. WEEE: The importing company acts as the PRODUCER of EEE<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p>The electric ride-on cars incorporated a motor, batteries, wiring, and electronic components. From a legal standpoint, this makes them electrical and electronic equipment.<\/p>\n\n\n\n<p>When a company places this type of product on the Spanish market for the first time, <strong>it acquires the legal status of PRODUCER of EEE<\/strong>, even if it is not the manufacturer.<\/p>\n\n\n\n<p>In practice, this means that before marketing the product \u2014 and, in effect, before customs clearance \u2014 the company must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Be registered as a PRODUCER of EEE.<\/li>\n\n\n\n<li><strong>Register in the corresponding Register<\/strong>.<\/li>\n\n\n\n<li><strong>Join a waste management system<\/strong>.<\/li>\n\n\n\n<li>And declare the volumes placed on the market.<\/li>\n<\/ul>\n\n\n\n<p>In this case, none of these steps had been taken. Without this prior registration, customs clearance was not viable.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"5.-RoHS:-a-demonstrable-technical-obligation\" style=\"font-size:clamp(1.743rem, 1.743rem + ((1vw - 0.2rem) * 2.095), 3rem);\"><strong>5. RoHS: a demonstrable technical obligation<\/strong><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<div class=\"wp-block-media-text has-media-on-the-right is-stacked-on-mobile\" style=\"grid-template-columns:auto 47%\"><div class=\"wp-block-media-text__content\">\n<p>In addition, the product had to comply with <a href=\"https:\/\/comercio.gob.es\/ImportacionExportacion\/Controles\/Documents\/PRESENTACION%20ROHS%20RESUMIDA%20%20V2%20DEF.pdf\">RoHS regulations<\/a>, which restrict the use of certain hazardous substances in electrical and electronic equipment.<\/p>\n\n\n\n<p>This compliance is not based on a generic declaration.
